CLIENT LIABILITY WAIVER
Between Atlas Training Co. and Client/Member
(Covers All Classes, Programs, Training & Locations)
RELEASE OF LIABILITY AND WAIVER (“AGREEMENT”)
This Release of Liability and Waiver (“Agreement”) is entered into by the undersigned individual (“Client”) and Atlas Training Co., a California corporation, including its brands Atlas Training Gym and Atlas Training Club, as well as all programs conducted at or in partnership with Muscle Force Personal Training Studio, Inc., located at 700 E. Tahquitz Canyon Way, Suite 1, Palm Springs, CA 92262, and any offsite classes, events, workshops, virtual sessions, or outdoor activities (collectively, the “Programs”).
In consideration for access to these Programs and facilities, Client voluntarily agrees to the terms below.
1. Release of Liability
Client, on behalf of themselves and their heirs, executors, administrators, and assigns, hereby releases, waives, and discharges:
Atlas Training Co.
Atlas Training Gym
Atlas Training Club
Muscle Force Personal Training Studio
and all respective owners, directors, officers, employees, staff, volunteers, trainers, independent contractors, representatives, agents, affiliates, successors, landlords, and partners (collectively, the “Released Parties”) from any and all liability, including claims for personal injury, illness, property damage, or death arising from participation in any Program or presence at any Program location. This includes claims arising from ordinary negligence.
2. Assumption of Risk
Client understands that participation in fitness activities and the use of gym equipment involves inherent risks, including but not limited to slips, falls, collisions, dropped weights, equipment malfunction, overexertion, dehydration, muscle strain, cardiovascular events, or outdoor environmental hazards. Client knowingly and voluntarily assumes all such risks, whether foreseeable or unforeseeable.
3. Offsite & Outdoor Programs
This waiver applies to all Atlas and Muscle Force activities, including indoor classes, personal training, outdoor workouts, runs, hikes, mobility events, pop-up classes, workshops, and virtual sessions. Client acknowledges that offsite activities involve additional risks and voluntarily accepts them.
4. Indemnification
Client agrees to indemnify, defend, and hold harmless all Released Parties from any claim brought by any third party, any injury or damage caused by the Client, any damage to equipment or facilities, or any violation of this Agreement. Client agrees to reimburse any attorneys’ fees or costs incurred to enforce this Agreement.
5. Emergency Medical Care
Client authorizes staff or contractors of the Released Parties to provide first aid, call emergency services, or arrange transport to medical facilities. Client assumes all financial responsibility for such services.
6. Nutrition, Wellness & Lifestyle Coaching
Client acknowledges that Atlas Training Co. provides general fitness, wellness, and nutrition guidance and does not provide medical care. Client assumes all risks related to nutrition or lifestyle recommendations.
7. Independent Contractor Trainers
Client understands that many trainers at Atlas Training Gym and Muscle Force are independent contractors operating their own businesses. Atlas Training Co. and Muscle Force are not liable for their conduct, representations, or omissions.
8. Rules & Conduct Requirements
Client agrees to follow all posted rules, wear proper attire, use equipment as intended, maintain respectful conduct, and refrain from exercising with contagious conditions. Violations may result in membership termination without refund.
9. Photography & Media Release
Client grants Atlas Training Co. and Muscle Force permission to photograph or record them and use such images for marketing or educational purposes in print or digital formats, with or without Client’s name. No compensation is owed.
10. Governing Law & Entire Agreement
This Agreement is governed by California law and intended to be as broad as permitted. If any portion is held invalid, the remainder remains enforceable. This Agreement constitutes the entire agreement between the parties.
CLIENT ACKNOWLEDGMENT
By signing below, Client acknowledges they have read, understand, and voluntarily agree to this Release of Liability and Waiver.
